An employment tribunal has ruled that a former hotel worker employed by Luxury Family Hotels was unfairly dismissed and had an unlawful deduction of wages.
Molly Murphy, who worked at Fowey Hall Hotel in Cornwall for three years, found that after a period of furlough during lockdown, and her lodging a complaint against another member of staff, the hotel did not have any hours or work to give her.
The tribunal judge ruled that unlawful deductions were made from Murphy’s pay and ordered the hotel pay her £3,044.18. A further claim of disability discrimination was thrown out.
Employment judge CH O’Rourke said: “The claimant’s application to amend her claim to include a claim of unlawful deduction from wages being granted, the respondent unlawfully deducted £362 from her wages for the months of November and December 2020. The claimant’s claims of disability discrimination and automatic unfair dismissal and detriment on the grounds of protected disclosure fail and are dismissed.”
A spokesperson for Luxury Family Hotels, which owns the hotel, added: “Following a claim by a former employee, an employment tribunal recently came to a conclusion after a hearing in October. Although a modest compensation order arose from the circumstances in which our ex-employee chose to leave our employment, this was substantially reduced due to their contributory fault.
“The tribunal made clear findings in our favour regarding allegations of harassment and discrimination. Moving forward, we will consider learning points and ensure that we follow best practice to achieve our aspiration of being an employer of choice in the Fowey area.”
